A lot of people walk into my office hoping to get divorced without setting foot in a courtroom. And truth be told, in Tennessee—especially here in Shelby County—that’s usually possible… if everyone plays ball.

What Counts as “Staying Out of Court”?

If both parties agree on every issue—who gets what, where the kids sleep, how the bills get split—then you’re looking at an uncontested divorce. That’s the cleanest, fastest path. You still have to file the right paperwork, and one party—the plaintiff—will need to appear for a short final hearing.

But don’t sweat it. In most Shelby County cases, that hearing is five minutes long. I ask my client their name, whether they signed the documents, and if everything remains true and correct. Then the judge signs off. Rubber stamp. You’ll spend more time parking than testifying.

What If There Are Kids?

When children are involved, Tennessee requires:

• A Permanent Parenting Plan (PPP)
• A Child Support Worksheet
• And in most counties, proof of parenting class completion

Even with those requirements, I’ve only had one plan kicked back by the court in over two decades. Judges here expect both parties to know their roles and responsibilities. If the plan’s clear and meets the minimum standards, it’s usually approved without issue.

Mediation Can Help You Stay on Track

If there’s one or two sticking points—who gets the tax exemption, or how to handle visitation swaps—mediation can keep things from going nuclear. It’s private, cheaper than trial, and often gives folks the nudge they need to wrap it up without dragging it out.

Just don’t confuse “we’ll figure it out later” with a valid legal agreement. If you want the court to leave you alone, give it something solid to sign.

In Shelby County, only the plaintiff has to appear. No cross-examinations, no Perry Mason moments. If you’ve done the work on the front end, this final step is usually smooth sailing.

Bottom Line

If both parties are reasonable, organized, and willing to sign, then yes—you can finalize a divorce without dragging both of you into court. One quick hearing, a few formal questions, and you’re done.

But if someone decides to change their mind midstream or refuses to cooperate? That’s when things get interesting—and expensive.
