What Is Mediation?
Mediation is a structured negotiation facilitated by a neutral third party, the mediator. In a divorce context, the mediator meets with both parties and their attorneys, separately and sometimes together, to help them identify areas of agreement and work through areas of dispute. The mediator does not make decisions. The mediator does not rule on anything. The mediator’s job is to help both sides reach an agreement they can live with.
What is said in mediation is confidential and cannot be used as evidence if the case goes to trial.
Mandatory Mediation in Tennessee
Tennessee courts require mediation in contested divorce cases before a trial date will be set. Most local rules also require mediation in contested custody cases. The cost of mediation is typically split equally between the parties unless the court orders otherwise.
